The provisions of Directive 89/665/EEC ensure rapid and effective procedural mechanisms for challenging breaches in public procurement. This imperative for effectiveness is closely linked to the right to effective judicial protection under art. 47 of CFR. The established paradigm of human decision-making in procurement is changing due to the growing use of algorithms and Artificial Intelligence (AI) by contracting authorities. This article analyses the effectiveness of the existing remedies framework, particularly post-contractual remedies, against the backdrop of increasing digitalization and AI adoption in public procurement. The study explores whether the current architecture can accommodate these technological realities, or if a necessary reform is needed to maintain rapid and effective review procedures.
