Tra le sfide ineludibili a cui il diritto, e segnatamente quello minorile, non può sottrarsi, vi è indubbiamente la tutela del minore in ambito digitale. La sempre maggiore frequenza del mondo informatizzato da parte delle persone di minore età sta ridefinendo gli stessi paradigmi della responsabilità genitoriale, chiamata ad esercitare i doveri di cura, protezione ed educazione anche oltre il mondo fisico, appunto in quello virtuale. Nel momento in cui, però, sono gli stessi esercenti responsabilità genitoriale, ossia coloro che sono incaricati di vigilare sul comportamento e il benessere dei figli, ad esporre questi ultimi ai rischi connessi la pubblicazione di dati sensibili di soggetti più vulnerabili, si genera un corto circuito, a cui il diritto è chiamato a dare una risposta in termini di regolamentazione e tutela. È questo il “caso serio” dello sharenting.
Among the inescapable challenges that the law—particularly juvenile law—must confront is the protection of minors in the digital environment. The increasing presence of minors in the digital sphere is reshaping the very paradigms of parental responsibility, which is now required to fulfill its duties of care, protection, and education not only in the physical world but also in the virtual one. However, when it is the very holders of parental responsibility—those entrusted with overseeing the conduct and well-being of their children—who expose them to the risks associated with the dissemination of sensitive data concerning vulnerable individuals, a paradox arises. This normative short-circuit demands a legal response in terms of regulation and protection. This is the serious legal issue posed by the phenomenon of sharenting.
