This article starts with a question that Directive (EU) 2024/1069 and domestic case law pose with growing clarity: to whom protection is owed among those who take part in public debate. It argues that the axis of protection has shifted from professional status to the substantive structure of the informative activity: the defence of report and criticism does not presuppose enrolment in the professional register nor the status of the press, which case law reserves to the structured online newspaper alone, but follows the method of the activity, the checking of facts, relevance to the public interest and restraint. Against this background the work examines the Italian situation in the light of the draft legislative decree submitted to Parliament on 9 July 2026, engages with the opposite thesis concerning the risks of an indiscriminate protection of public discourse, and isolates the technique of coordinated actions on multiple fronts, showing that the indicator of abusiveness laid down in the draft, anchored to the identity of the cause of action, fails to capture it.
