Presupponendo l’esistenza di un forte legame tra durata delle indagini preliminari e instaurazione di un “processo mediatico”, l’articolo analizza le modifiche introdotte dal d.lgs. 150/2022 alla disciplina dei termini investigativi e di “riflessione” del p.m. e alla regola di giudizio per l’esercizio dell’azione penale. Si mostrerà come tali novità non solo incrementino il peso della fase investigativa a scapito del dibattimento, ma favoriscano dei verdetti mediatici precoci sulla responsabilità dell’indagato o dell’imputato. Si illustreranno, dunque, le possibili soluzioni normative, culturali e giudiziali, nel loro insieme funzionali a preservare la correttezza dell’informazione giudiziaria nonché il diritto di difesa e il diritto alla reputazione della persona sottoposta al processo penale.

Assuming a strong link between the lenght of preliminary investigations and “trial by media”, the article examines the reforms introduced by Legislative Decree 150/2022 to investigative time limits, to the prosecutor’s decision period and to the rule of judgment for exercising the criminal action. It will be shown how these changes expand the investigative phase at the expense of the public trial phase, as well as they favor early mediatic judgments on suspect’s liability. Therefore, legislative, cultural, and judicial solutions will be illustrated, as a whole functional to protect the correctness of judicial information, the defense right, and the reputation of the person implicated in a criminal trial.
